The crime commonly referred to as rape is deemed "sexual assault" in New Jersey.
Sex crime cases may contain circumstances that make them more volatile than other types of criminal cases. That is why it is so crucial that you have an attorney you can trust. For most people, being accused of a sex offense is extremely embarrassing and devastating. Many times the accuser is a young child who is suggestible and therefore not always reliable. If the victim is related to the accused, division may occur within the family. Additionally, false accusations of sexual abuse are sometimes invented by one parent attempting gain an advantage over the accused parent in custody disputes.
Our attorneys are willing and able to try sexual assault cases. We defend clients charged with sex crimes throughout South Jersey, including Wildwood, Pleasantville, Atlantic City, Cape May Court House, and Toms River. Our attorneys have experience cross examining alleged victims of sexual abuse, child psychologists and medical doctors who examine alleged victims of sexual abuse.
Some sex offenses include: Aggravated sexual assault, sexual assault, criminal sexual contact, endangering the welfare of a child by engaging in sexual contact, and child luring. In New Jersey, the most severe prison sentences are authorized for those convicted of first degree crimes. Aggravated sexual assault is a first degree crime; therefore it carries a potential prison sentence of up to 20 years for each count. Besides a lengthy prison sentence, an experienced attorney may be able to help you avoid other serious consequences, which may include:
Megan's Law Registration
In New Jersey, persons convicted of most but not all, sex offenses are required to register under Megan's Law. That means that they must register with certain public agencies. They must also notify the appropriate law enforcement agencies before they change residences and verify their address periodically. Failure to register as required is a crime in and of itself. Many people make mistakes regarding registration and find themselves back in court facing a new charge.
Community Supervision for Life
If a person is convicted of certain sex offenses that occurred before January 14, 2004, the court, in addition to any other sentence, will impose a special sentence of community supervision for life (CSL). This means that the convicted person "will be supervised for at least 15 years as if on parole, and subject to conditions appropriate to protect the public and foster rehabilitation, including, but not limited to, counseling and other restrictions, which may include restrictions on where you can live, work and travel." If you violate a condition of community supervision for life you can be sentenced to additional time in prison.
Parole Supervision for Life
If a person is convicted of certain sex offenses that occurred on or after January 14, 2004, the court, in addition to any other sentence, will impose a special sentence of parole supervision for life. This means that the convicted person "will be supervised by the Division of Parole for at least 15 years, and be subject to provisions and conditions of parole, including conditions appropriate to protect the public and foster rehabilitation, such as, but not limited to, counseling and other restrictions, which may include restriction on where you can live, work and travel." If you violate a condition of parole you can be sentenced to additional time in prison.
