What Are the Fines and Jail Sentences if I’m Convicted of a Crime in New Jersey?

Most states divide criminal offenses into two categories: misdemeanors, which are lesser offenses, and felonies, which are the most serious types of crimes.  However, New Jersey uses unusual language, which can be confusing for visitors from out of state, and even New Jersey residents who have never been arrested or charged with a crime.  Misdemeanors are called “disorderly persons offenses” or “DP offenses,” while felonies are known as “indictable crimes,” or merely “crimes.”

Unlike indictable crimes, DP offenses are not technically criminal offenses.  However, this distinction is of little benefit to defendants who are found guilty of DP offenses, because a conviction can still lead to incarceration and heavy fines, as well as a criminal record.  The penalties for indictable crimes are even harsher, and moreover, the stigma of having a prior felony conviction can make it all but impossible to find work.

New Jersey enforces tough criminal penalties for crimes and offenses at all levels.  If you are convicted of an indictable crime or DP offense after Roar to the Shore, you could be facing the following consequences:

  • Petty DP Offense
    • Fine – Up to $500
    • Sentence – Up to 30 days in jail
  • DP Offense
    • Fine – Up to $1,000
    • Sentence – Up to 6 months in jail
  • Fourth Degree Crime
    • Fine – Up to $10,000
    • Sentence – Up to 18 months in prison
  • Third Degree Crime
    • Fine – Up to $15,000
    • Sentence – Up to 5 years in prison
  • Second Degree Crime
    • Fine – Up to $150,000
    • Sentence – Up to 10 years in prison
  • First Degree Crime
    • Fine – Up to $200,000
    • Sentence – Up to 20 years in prison

Depending on the nature of the offense, your criminal history, and other factors, you could also face additional consequences, including but not limited to:

  • Community service
  • Loss of your gun privileges
  • Probation
  • Revocation or suspension of your driver’s license
  • Sex offender registration
  • Victim restitution
